House Bill 837 was signed into law in March of 2023 in Florida. Under the new law, the statute of limitations to file a personal injury lawsuit in Florida has been reduced from four years to two years from the date of injury. It has also laid into place a modified comparative negligence system for compensation in personal injury claims. Under this new system, a plaintiff found to be more than 50% at fault for the injury is not eligible to recover damages. Furthermore, the law requires evidence provided in order to establish damages already paid for to reflect the amount actually paid, rather than the initial charge.
